These Terms also include information about future changes to these Terms, automatic renewals, limitations of liability, a class action waiver, and dispute resolution by arbitration instead of in court. PLEASE NOTE THAT YOUR USE OF AND ACCESS TO OUR SERVICES ARE SUBJECT TO THESE TERMS; IF YOU DO NOT AGREE TO ALL OF THE TERMS, YOU MAY NOT USE OR ACCESS THE SERVICES.

You are responsible for ensuring that all information you provide to us is accurate, complete, and up-to-date. You may not use false information or impersonate another person through the Services. You may not transfer your account to anyone else without our written permission.

4. Use of Services

EIMG AI provides AI-powered image generation services. This includes text-to-image generation, image editing, style transfer, and related services. By using EIMG AI, you agree to the following:

• You will not use the Services for any purpose that is illegal or prohibited by these Terms
• You will comply with all laws that apply to your use of the Services
• You will not violate the security of the Services, including by attempting to obtain unauthorized access to any portion of the platform
• You will protect the security of your account by keeping your login credentials confidential. You are responsible for any activities that occur under your account

Special Terms for AI-Generated Content

When using our AI image generation services, you acknowledge and agree that:

• Generated content may not fully meet your expectations, and we do not guarantee specific results
• You will not use the Services to generate illegal, harmful, misleading, infringing, sexually explicit, pornographic, nude, or NSFW content
• You will not generate, upload, request, or distribute images containing:
  • Child pornography or exploitation material
  • Any sexually explicit, pornographic, nude, or NSFW content, whether consensual or non-consensual
  • Unauthorized face swaps, deepfakes, synthetic likenesses, impersonation content, or other content intended to deceive or mislead
  • Content that incites violence or hatred
  • Content that infringes copyright or trademarks
• You will not create, upload, sell, distribute, or otherwise make available any unauthorized deepfake or synthetic content involving real individuals, including public figures, private individuals, political figures, employees, customers, or any other identifiable real person
• You will not impersonate any person or entity, falsely imply endorsement, affiliation, authorization, or consent, or use another person's name, image, video, voice, likeness, or other personal attributes without the rights and permissions required by applicable law
• You will only upload, prompt, generate, edit, publish, or share real-person materials when you have proper authorization, licenses, likeness rights, copyright rights, and consent from the person concerned
• You will not use the Services for extortion, fraud, harassment, defamation, political deception, non-consensual sexual content, or any other misleading or abusive use involving real individuals
• You are fully responsible for the use of content generated through our Services

5. Fees and Payment

Pricing and Fees

Some of EIMG AI's Services may require payment of fees. Fees for our Services are clearly outlined and subject to change. We will notify you of any changes in advance. Refunds are available as described in our Refund Policy (/refund).

Payment Processing

By using our paid Services, you agree to pay all applicable fees. If you choose to use paid Services, we will bill you through the payment method you have provided. You must keep your billing information up to date and accurate.

We work with third-party payment processors (including Stripe) to handle payments. Your payment information will be processed according to their privacy policies and terms of service.

Subscriptions and Auto-Renewal

Certain Services may be offered on a subscription basis. Subscriptions will automatically renew unless you cancel before the end of the current billing period. You can cancel your subscription at any time through your account settings.

Credit System

Our Services use a credit system for image generation:

• Credits can be obtained through subscriptions or one-time purchases
• Different generation tasks consume different amounts of credits
• Unused credits may expire depending on your plan type
• Credits are non-transferable. Refunds or credit adjustments may be granted as described in our Refund Policy (/refund)

6. Intellectual Property

Our Content

The Services and their original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of EIMG AI and its licensors. The Services are protected by copyright, trademark, and other laws both domestically and internationally.

Your Content

You retain all rights to any content you submit to the Services (including text prompts and uploaded images). By submitting content, you grant EIMG AI:

• A worldwide, non-exclusive, royalty-free license to use, process, and store your content to provide the Services
• The right to improve our AI models and services (using anonymized and aggregated data)

AI-Generated Content

Content generated using AI models through our Services:

• You have the right to use it subject to compliance with these Terms
• May be subject to additional terms from underlying AI model providers
• Should not be considered your exclusive property, as similar content may be independently generated by other users

7. User Responsibilities and Prohibited Activities

By using the Services, you agree that you will not:

• Engage in any fraudulent, illegal, or abusive behavior
• Attempt to interfere with the proper working of the Services
• Violate any applicable laws or regulations while using the Services
• Use any automated system (such as bots or scrapers) to access the Services in a way that could disrupt our operations
• Misrepresent yourself or your affiliation with any individual or entity
• Circumvent or attempt to circumvent any usage limitations we implement
• Resell or commercialize access to the Services unless explicitly authorized by us
• Use the Services to send spam or conduct phishing
• Upload or transmit viruses or any other type of malicious code
• Create, upload, sell, distribute, or promote unauthorized deepfake content, impersonation content, or deceptive content involving real individuals
• Attempt to bypass, disable, or interfere with any content moderation, safety, or abuse-prevention controls we implement

Violation of any of the above restrictions can result in termination of your access to the Services.

8. Content Moderation and Enforcement

We reserve the right, but have no obligation to:

• Monitor the Services for violations of content or conduct
• Remove or refuse to display content that we believe violates these Terms
• Block or refuse generation requests, uploads, prompts, outputs, or account activity that we believe may involve unauthorized deepfakes, impersonation, misleading real-person content, or other misuse
• Require additional information or verification when content appears to involve a real or identifiable person
• Suspend or terminate access for users who violate these Terms
• Cooperate with law enforcement regarding illegal activities

9. Termination

EIMG AI reserves the right to terminate or suspend your access to the Services at any time, without notice, for conduct that violates these Terms or is harmful to our operations or other users. Upon termination, your right to access the Services will immediately cease.

You may terminate these Terms at any time by deleting your account. Termination will not affect any rights or obligations incurred prior to termination.

10. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE SPECIFICALLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUALITY.

WE DO NOT WARRANT THAT:

• The Services will be uninterrupted, secure, or error-free
• The Services will meet your requirements or expectations
• Any content generated through the Services will be accurate, reliable, or of satisfactory quality
• Any defects or errors in the Services will be corrected

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NANO BANANA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICES, EVEN IF NANO BANANA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL NANO BANANA'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF $100 OR THE AMOUNTS PAID BY YOU TO NANO BANANA IN THE PREVIOUS 12 MONTHS.

12. Indemnification

You agree to indemnify and hold harmless EIMG AI, its affiliates, and employees from any claims, liabilities, damages, or expenses (including legal fees) arising out of your use of our Services, your violation of these Terms, or your violation of any third-party rights.

13. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Informal Resolution

Before filing any legal action, you agree to try to resolve the dispute informally by contacting support@eimg.ai. We will attempt to resolve the dispute informally via email.

Arbitration Agreement

If we cannot reach an informal resolution, any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration. Both parties agree to resolve disputes through individual arbitration rather than class actions or lawsuits.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Miscellaneous

Entire Agreement

These Terms constitute the entire agreement between you and EIMG AI with respect to your use of the Services.

Severability

If any part of these Terms is held invalid, the remaining parts will remain in full force and effect.

Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms at any time without notice or consent.

Waiver

The failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
